Nasdaq, Inc., and Affiliated Companies – Data Processor Privacy Notice

This Data Processor Privacy Notice applies to services, websites, mobile applications, and other applications (each a “Customer Application”) where Nasdaq, Inc. or an affiliate of Nasdaq, Inc. (collectively, “Nasdaq,” “we,” “our” or “us”) processes personal data on behalf of a customer where this Processor Privacy Notice appears on the sign-on screen, page footer or is otherwise referenced in the relevant terms of use for the Customer Application. The company (or its subsidiary or affiliate) that has provided you with login credentials for a Customer Application under its agreement with Nasdaq is Nasdaq’s customer (“Customer”).
Permitted use of the Customer Application is governed solely and exclusively by the contractual agreements between Nasdaq and our Customer. In using a Customer Application, you may be subject to our Customer’s policies, procedures, and other requirements (including, but not limited to, its privacy and data protection policies) for users of applications or services supporting our Customer’s operations. You should direct any questions related to such policies, procedures, and other requirements to the Customer that is authorizing you to be a user of the Customer Application. Because Nasdaq is providing the Customer Application on behalf our Customer, if you contact Nasdaq regarding the Customer Application or any activity within the scope of Nasdaq’s services to our Customer, you acknowledge and agree that we may refer your inquiry to the Customer for resolution (unless prohibited by applicable law). Following such referral, Nasdaq shall have no further obligation to address your inquiry, except as required by applicable law, and you agree to address such inquiry solely with our Customer.
When you attempt to access a Customer Application (including, but not limited to, logging into an existing account or creating a new account as an authorized user of a Customer) or contact Nasdaq for “help desk” or similar support related to use of our products and services, Nasdaq may process your personal information as further described in our Privacy Policy, including authenticating you as a user, securing our systems and networks, and providing you with requested support. For these limited uses of your personal data, Nasdaq is considered the “data controller” or “owner” of the personal data it processes.
Following successful access to a Customer Application, we may process your personal information or other personal information that you input or upload to the Customer Application on behalf of our Customer subject to the agreement between Nasdaq and our Customer. Any personal data (as defined in the agreement between Nasdaq and its Customer) processed by a Customer Application on behalf of our Customer, including as a “processor” or “service provider” to our Customer, is governed solely and exclusively by the agreement between Nasdaq and our Customer. For such personal data processing, our Customer is the “data controller” or “owner” of the personal data. For any questions on processing of personal data by a Customer Application, please consult with the Customer and its privacy policy.
Use of interfaces of the Customer Application with other applications licensed separately by our Customer or an affiliate of our Customer (an “Interfaced Application”) are governed by the relevant Customer Application agreement, terms of use for the interface and, if applicable, the agreement between our Customer and service provider/licensor of the Interfaced Application. If you elect to use an interface between the Customer Application and an Interfaced Application, Nasdaq may transmit your personal data to the Interfaced Application to enable you to use it. Nasdaq’s transmission of this personal data is done on behalf of our Customer and as a “processor” or “service provider” to it; once transmitted, any processing of personal data by the Interfaced Application shall be governed solely and exclusively by the relevant terms established between our Customer and the licensor/provider of the Interfaced Application. Nasdaq makes no representations, warranties, or other commitments regarding the processing of personal data by the licensor/provider of the Interfaced Application. For any questions regarding such processing, please consult with the Customer and, if applicable, the licensor/provider of the Interfaced Application.
