Consumer shares are fairly flat in pre-bell trading. Tesla ( TSLA ) is seeing bullish play in early pre-market action following an All Things D column in the WSJ this weekend that notes car sales figures in California state that Tesla has secured 12% of the luxury sports car category in the state in the first half of 2013. The electric car maker is outselling the likes of Porsche, Volvo, Cadillac, Jaguar and Land Rover.

And, ConAgra Foods ( CAG ) said Monday that, in cooperation with the U.S. Food and Drug Administration, it is recalling a limited number of Kroger's Break 'N Bake chocolate chip cookie dough packages.

The company said that peanut butter cup cookie dough was inadvertently mispacked into chocolate chip cookie dough packages. This could pose serious or life-threatening allergic reaction to people with allergy or severe sensitivity to peanuts, should they consume the mispacked cookie dough packages.

There have been no illnesses reported to date in connection with this product. CAG shares closed at $35.08 with a 52-week range of $24.61 - $37.28.
